1. ACCEPTANCE OF TERMS
By accessing or using ScanlyApp ("ScanlyApp," "we," "our," or "us"), including our website, dashboard, API, and related services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. DESCRIPTION OF SERVICE
ScanlyApp provides automated QA scanning and reporting features for websites and web applications, including:
- Scan execution, issue detection, and run history
- Performance analysis and diagnostics
- Artifact and evidence handling (for example, screenshots, traces, logs, and exports)
- Team and workspace collaboration capabilities
- Integrations with third-party services and infrastructure providers
3. ACCOUNT ELIGIBILITY AND SECURITY
You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. You are responsible for:
- Maintaining secure account credentials
- All activities under your account
- Notifying us promptly of unauthorized access
4. ACCEPTABLE USE
You agree not to:
- Use the Service to scan or access systems without authorization
- Attempt to bypass security controls or access restrictions
- Upload or process unlawful, infringing, or harmful content
- Interfere with or disrupt the Service or related infrastructure
- Use the Service in a way that violates applicable laws or third-party terms
5. CUSTOMER DATA AND SCAN CONTENT
You retain ownership of your content and data submitted to the Service ("Customer Data"). You grant us a limited, non-exclusive right to process Customer Data as necessary to provide, secure, and improve the Service in accordance with our Privacy Policy.
You represent that you have all rights and permissions necessary for any domains, environments, credentials, and data you submit for scanning.
6. THIRD-PARTY SERVICES
The Service may interoperate with third-party providers (for example, hosting, storage, authentication, payment, and analytics providers). Your use of third-party services is subject to their terms and policies. We are not responsible for third-party services outside our reasonable control.
7. PRIVACY AND DATA USE
Our handling of personal information is governed by our Privacy Policy. By using the Service, you acknowledge and agree to our data practices described there.
8. SERVICE AVAILABILITY
We strive for reliable availability but do not guarantee uninterrupted or error-free operation. Planned maintenance, upgrades, and unexpected outages may occur.
9. TERMINATION
You may terminate your account at any time. We may suspend or terminate accounts for violations of these Terms or misuse of the Service.
10. BILLING, MERCHANT OF RECORD, AND REFUNDS
Payments for paid plans are processed by Paddle.com Market Ltd, our authorized reseller and Merchant of Record. Your payment statement will reference Paddle. By purchasing a subscription, you agree to Paddle's checkout terms as well as these Terms.
Refund eligibility is governed by our Refund Policy at /refund-policy.
11. DISCLAIMERS
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCANLYAPP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR USD $100 IF NO FEES WERE PAID.
13. GOVERNING LAW
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
